Eligibility

You must be at least 18 years old and have the legal capacity to enter into binding contracts to use our services. By using our services, you represent and warrant that you meet these requirements.

Services Description

Service Offerings

Lumino Technology provides web development, mobile app development, UI/UX design, digital strategy consulting, and related technology services. Specific deliverables and timelines will be outlined in individual project agreements.

Service Modifications

We reserve the right to modify, suspend, or discontinue any part of our services at any time with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation.

Third-Party Services

Our services may integrate with third-party platforms and services. We are not responsible for the availability, accuracy, or content of these third-party services.

Payment Terms

Pricing and Billing

Service fees will be agreed upon in individual project contracts or service agreements. Payment terms, including deposit requirements and milestone payments, will be specified in your project agreement.

Late Payments

Late payments may incur interest charges of 1.5% per month (or the maximum allowed by law). We reserve the right to suspend services for accounts with overdue balances.

Refund Policy

Refunds are handled on a case-by-case basis as outlined in individual project agreements. Generally, deposits and completed work are non-refundable. Any refund requests must be submitted in writing.

Intellectual Property

Ownership of Deliverables

Upon full payment, you will own the final deliverables as specified in your project agreement. However, we retain ownership of any pre-existing intellectual property, tools, methodologies, and code libraries used in the development process.

Portfolio Rights

We reserve the right to display completed projects in our portfolio, case studies, and marketing materials unless otherwise agreed in writing. We will not disclose confidential business information without your consent.

Third-Party Rights

You are responsible for ensuring that any content, images, or materials you provide do not infringe on third-party intellectual property rights. You agree to indemnify us against any claims arising from such infringement.

Project Changes and Cancellations

Change Requests

Changes to project scope, features, or requirements may result in additional fees and timeline extensions. All change requests must be submitted in writing and approved before implementation.

Client Cancellation

If you cancel a project, you will be charged for all work completed up to the cancellation date, plus any non-refundable expenses incurred. Deposits and payments for completed milestones are non-refundable.

Lumino Cancellation

We reserve the right to terminate projects if you breach these terms, fail to make payments, or if continuing the project is not feasible. In such cases, you will be charged for work completed.

Limitations of Liability

Warranty Disclaimer

Our services are provided 'as is' without warranties of any kind, either express or implied. We do not guarantee that our services will be error-free, uninterrupted, or meet your specific requirements.

Limitation of Damages

To the maximum extent permitted by law, Lumino Technology shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.

Maximum Liability

Our total liability for any claims arising from our services shall not exceed the total amount paid by you for the specific services giving rise to the claim.

User Responsibilities

Accurate Information

You agree to provide accurate, complete, and up-to-date information required for the delivery of our services. You are responsible for maintaining the confidentiality of your account credentials.

Prohibited Uses

You may not use our services for any illegal purposes, to transmit harmful code, to infringe on others' rights, or to engage in any activity that could damage, disable, or impair our services.

Content Responsibility

You are solely responsible for all content, data, and materials you provide. You warrant that you have all necessary rights and permissions for any content you submit to us.

Dispute Resolution

Governing Law

Arbitration

Our failure to enforce any right or provision of these terms will not be considered a waiver of those rights.
